With its judgement of 12 May 1998, the Regional Court of Hamburg ruled that persons who place links on websites can in some cases be held jointly responsible for the contents of the linked sites. According to the Regional Court, this responsibility can only be avoided if the party concerned expressly distances itself from these contents. The websites of Wicoplast GmbH contain links to other Internet sites. With respect to all of these links, Wicoplast GmbH expressly declares that it does not have any form of influence on the design or contents of the linked sites. Consequently, Wicoplast GmbH hereby expressly distances itself from all contents of all sites accessible via links on this website and dissociates itself from these contents. This declaration applies to all links appearing on this website and all contents of the sites accessible via the banners, buttons and links appearing on this website. Automatic querying of our databases by software scripts or comparable mechanisms is not allowed without our permission. In this regard, we refer to Sect. 303a of the German Criminal Code (StGB), Datenveränderung (‘modification of data’): Any person who unlawfully deletes data (Sect. 202a clause 2), renders data unusable, or modifies data, will be punished with imprisonment up to two years or a fine. The attempt is punishable. And to Sect. 303b of the German Criminal Code (StGB), Computersabotage (‘computer sabotage’): Any person who interferes with a data processing activity of substantial importance to an external business, enterprise or official body by committing an offence as described in Sect. 303a clause 1. or by destroying, damaging, rendering unusable, eliminating, or modifying a data professing system or a data storage medium, will be punished with imprisonment for up to 5 years or a fine. The attempt is punishable. We also refer specifically to Decision Az. 19 U 2/00 of the Higher Regional Court of Cologne, dated 28 August 2000, which grants us ‘virtual domiciliary rights’ for avoidance of disturbances, which we employ as necessary.
